Independent Contractor Legislation


A bill has been introduced (A5953/S4204) that would restrict the use of independent contractors in many circumstances. It would require that they be hired as employees. Similar legislation was enacted recently in California. The bill was amended to exempt CPAs in the last legislative session but would still hurt many businesses. It was steam rolling through the Legislature, but with an enormous outcry from business owners it was put on hold because the votes weren’t there for it get through a floor vote in the Senate. Its future in the new legislative session is uncertain, but it remains a priority for Senate President Sweeney.
