Scott Borsack has more than 25 years of experience focusing on transactional tax planning, income tax planning, estate planning and tax controversy defense. Working as part of a team representing clients, Mr. Borsack is routinely called upon to structure a variety of transactions to minimize the burden of federal and state taxes. Mr. Borsack has worked with clients and their advisors to bring tax efficiency to mergers, acquisitions, dispositions, fund formations, workouts and debt restructuring, inbound and outbound investments, compensation planning and the use of tax pass-through entities such as partnerships and S corporations. Developing a tax strategy before transactions get off the ground allows for efficient implementation and maximization of client goals.Mr. Borsack also counsels clients on the means of passing wealth from one generation to another while limiting federal and state taxes, using sophisticated techniques involving pass-through entities and trusts. With an eye toward wealth succession, Mr. Borsack is able to introduce estate tax saving concepts to entrepreneurs while developing plans for a liquidity event, as well. Inevitably, estate planning also requires participation in estate administration matters, and Mr. Borsack is equally adept in this arena. Additionally, Mr. Borsack represents clients before federal and state taxing authorities. He has represented clients involved in all phases of civil and criminal tax investigations before administrative agencies as well as federal and state courts. As the Internal Revenue Service, in particular, has gotten more aggressive in its enforcement activities, the ability to defend positions before governmental authorities can be a significant benefit to clients.

Mr. Borsack has developed a specialized practice, working with owners of real estate in the Marcellus Shale formation who have leased their property for natural gas exploration. Working with geologists, market analysts and real estate appraisers, Scott is able to craft plans for clients which allow for the passage of future wealth to family members without the significant bite of estate, gift and inheritance taxes.

Before entering private practice, Scott began his career as a trial attorney for the United States Department of Treasury, representing the Commissioner of Internal Revenue before federal courts. Scott recently returned to the firm after spending six years in Philadelphia directing the Tax and Estates Practice for a major Center City law firm. Mr. Borsack is married and lives with his wife and two children in West Windsor, New Jersey.

Mr. Borsack is a frequent author and lecturer on topics of tax planning, estate planning and estate administration.

Judge Feinberg retired from the bench on March 1, 2012 having served with distinction. She leaves behind a legacy of fairness and professionalism in a judicial career that spans two decades. Since July 1997, Judge Feinberg has served as the Assignment Judge of the Mercer Vicinage, the top administrative position within the Vicinage. In addition to her administrative responsibilities, which included budget, personnel and facility matters, Judge Feinberg handled prerogative writs, complex civil litigation and government related litigation. Judge Feinberg also served as the Supervising Judge of the State Grand Jury, Chair of the Conference of Wiretap Judges and Chair of the Supreme Court Committee on Complementary Dispute Resolution. Judge Feinberg has served as a member on the Commission on Professionalism and, since 2010 has served as its Chair. In 1992, Judge Feinberg was appointed by the Governor to serve as a Judge of the Superior Court of New Jersey. After one year serving in the Family Part, Judge Feinberg became the Presiding Judge of the Family Part. While serving in the Family Part, Judge Feinberg presided over matrimonial, domestic violence, children in court and other related family matters. In January 1988, while serving as the Judge of three municipal courts, Judge Feinberg also became the Presiding Judge of all of the municipal courts in Mercer County. During her tenure as Presiding Judge, she developed and implemented an extensive community dispute resolution program that became a model for other municipalities. In 1985 she was appointed Judge of the Lawrence Township Municipal Court. Over the next few years she was appointed as the Judge of the Hopewell Township Municipal Court and the Judge of the West Windsor Township Municipal Court. Before joining the bench, Judge Feinberg served as a Labor Lawyer with the Department of the Army, an Assistant County Prosecutor in Mercer County, Assistant County Counsel in Mercer County, a tenured faculty member in the Department of Law and Justice at the College of New Jersey, and maintained a private practice. Since 1985, Judge Feinberg has been actively involved in the formulation of mediation practices in New Jersey. In her position at SzafermanLakind, she is available to provide mediation services, consultation and advice in land use and redevelopment matters, government related applications and issues, complex civil litigation and family matters. Judge Feinberg and her husband of 38 years are the proud parents of three sons, Adam, Matthew and Ben. Judge Feinberg is an avid reader and enjoys macro photography, hiking, biking and kayaking. She is actively involved in animal rescue and has five adopted dogs.
