Despite the high federal lifetime exemption, estate planning is still very important for state estate tax purposes, asset protection and a variety of other reasons. Taxpayers (especially New Jersey residents) should not make the mistake of thinking that they no longer have to be concerned about estate planning. Several key estate planning concepts will be explained including irrevocable life insurance trusts (ILIT), marital trusts, credit shelter trusts, etc.

Retaining basis in many estate plans has become more important than avoiding inclusion of assets in an estate. We will address proper drafting of estate planning documents with flexibility to obtain basis step-up when warranted, planning techniques to implement basis step-up in existing trusts, in assets to be gifted which would otherwise have carryover basis - and recapturing step up in basis with assets that have already been gifted!!

International Income and Estate Planning Issues and Compliance

Join us for a discussion regarding the rules that would have consequences for non-citizen and non-US persons for US income and estate taxes, including when an individual or entity is required to file a U.S. federal income, gift or estate tax return and reporting requirements. Definitions of U.S. persons for the above taxes and the compliance issues including the proper forms to file, issues regarding expatriating and pre-immigration planning will be explored.

Susan Dromsky-Reed helps families and individuals create plans which can simply and easily transfer assets to their heirs, while taking into consideration necessary income, estate, and inheritance tax planning. Her goal is to provide peace of mind and to promote family harmony, during the planning process and during estate administration. As part of her practice, she provides individuals and families with planning and tax advice regarding spousal, intergenerational, and business succession; charitable planning; life insurance planning; and preparation of prenuptial agreements. She assists individuals in creating wills, irrevocable trusts, and living revocable trusts. She also helps clients draft and understand financial powers of attorney, living wills, and health care agent designations.

Susan was admitted as a Fellow to the American College of Trust and Estate Counsel in late 2015. The College represents a group of only a little over 2,600 trust and estate lawyers and law professors elected by their peers in the country. To qualify for membership, a lawyer must have no less than 10 years’ experience in the active practice of probate and trust law or estate planning. Lawyers and law professors are elected to be Fellows based on their outstanding reputation, exceptional skill, and substantial contributions to the field. Susan was also named to the New Jersey Super Lawyers list from 2017-2019 and to The Best Lawyers in America© for 2019 and 2020. Additionally, Susan is a Trustee of the Essex County Estate Planning Council and a Board Member and Chair of the Scholarship Committee of Executive Women of New Jersey (EWNJ). EWNJ’s mission is to ensure that women have equal opportunity and representation in senior corporate leadership. Susan was elected in 2018 to the New Jersey State Bar Association’s Real Property Trust & Estate Law Section Board of Consultors. The Board of Consultors is responsible for reviewing potential legislation and making recommendations for legislation and regulations to the New Jersey Supreme Court and the Bar Association. In 2019, Susan was elected to the Executive Committee of Brach Eichler, the first woman in the firm’s history to assume this role. Earlier in her career, Susan was a law clerk for the Honorable Robert J. Passero (Ret.), Superior Court of New Jersey, Passaic County, Family Part. Ms. Dromsky-Reed is a member of the American Bar Association; a trustee of the Essex County Estate Planning Council; and a member of the Essex County Bar Association, Tax, Trusts & Estates Committee. She received her bachelor’s of arts in mathematics from Hamilton College; her J.D. from George Washington University School of Law, and her LL.M. in taxation from New York University.

A Fellow of the American College of Trust and Estate Counsel (ACTEC), Richard is a past chair of the Taxation Law Section of the New Jersey State Bar Association and a Legislative Coordinator and former chair of the Real Property, Trust and Estate Law Section, a member and former chair of the Corporate Tax Committee and a member of the Estate and Inheritance Tax and Partnership Tax Committees. He is a member and former president of the Tri-County Estate Planning Council and the Essex County Bar Association Tax Committee; a member of the New York State Bar Association and its Tax, Trusts and Probate Committees; and the Tax Committee of the Middlesex County Bar Association. Named as one of New Jersey’s Top 100 Lawyers, Richard is a frequent lecturer and author on numerous estate planning and estate administration topics.

Jack Meola has 30 years of public accounting, providing service to both private and publicly held companies. He is a member of the firm’s International Tax Services Group serving the following industries: Estate Planning, Real Estate, Telecommunications, Technology, Retail, Manufacturing, Pharma, and Biotech. Mr. Meola works with private and corporate clients regarding estate and succession planning, pension planning, corporate tax issues and family business matters. He directs EisnerAmper’s Bridgewater Estate Planning Group with an increasing presence in the International arena. FBAR Issues; withholding taxes and income tax treaty analysis; US real estate dispositions by foreign persons; coordinating with Foreign Partners and Technical Branches of the IRS/Treasury; cross-border reorganizations including mergers, acquisitions, and liquidations. His functional Competencies include: Technical expertise, International networking capabilities, Review and analysis of current plans and programs for optimal results. Mr. Meola is a member of the American Institute of Certified Public Accountants (AICPA) and New Jersey Society of Certified Public Accountants (NJCPA).
